Florida Boating License

By successfully completing this approved basic boating safety education course you may qualify for reduced boat insurance premiums. Please contact your insurance company to see if you qualify for a reduction in your premiums based on your completion of this course.

Those receiving boating citations from law enforcement may be required to take a safe boating course. However, this must be a classroom boater education course -- The online course does not meet this requirement.

Companies Looking To Save Money On Employee Benefits Are Turning To Voluntary Benefit Plans

No matter what size business you have your employee benefits are a key element in keeping your employees happy and reducing turnover ratois. We all know it is more costly to train a new employee and not have them remain on the job.

In an effort to save on premiums companies have increased their deductibles on their health plans and are now offering Voluntary Benefits to the employees. This allows the company to reduce overhead and the employee can opt in to the voluntary benefit plan at no additional cost to the employer. For the purpose of this post we will be discussing New York business risks. We are licensed to write is six states NY, NJ, CT, FL, PA & SC.

M.J.F. has secured a number of carriers who are willing to underwrite Commercial General Liability throughout the 5 boroughs and N.Y. State. The most difficult risks are for roofers because the potential for loss is greatest in this field. However, there are a limited number of carriers willing to write roofers. Hotels and motels can be great investments. The travel industry is not going away, and for this reason, there will always be a need for hotels and motels. While the investment in this industry is generally sound, not all hotels and motels are worth investing in. Here are some tips to consider when contemplating the purchase of a hotel or motel.



As with any purchase of real estate, the condition of the structure should be checked, and inspected by a professional. Necessary repairs, as well as the need for updated furnishings, fixtures, equipment, and inventory should be considered. This information will help you in determining the market value of the property. Once the sale is complete, make sure that the owner gives you a separate bill of sale for all furnishings, fixtures, equipment, and inventory, as well as the deed to the property.



Check with the county or state about planned changes and roadway construction. If the property is on a highway, and there are plans to build a loop, the property and business may not be as valuable as you thought it was.

Stay at the hotel as a guest for a week. Try to do this before anyone is aware that you are considering the property. This will give you the opportunity to view the hotel or motel as a guest would.

Avoid discussing price with the owner of the property. It is better to let the broker handle the negotiations with the owner. You should know in advance what the top dollar you are willing to pay for any property is, and disclose this information to the broker from the start.

If the hotel or motel is franchised, read the franchise disclosure. Also, view the franchise agreement that the current owner has with the company, and find out if that agreement will be transferred to you, or if you will have a new agreement with the company. Find out what fees you will be required to pay to the company upon taking over the property.

Check out the current competition, and consider the potential for future competition. Also consider the local reputation of the hotel or motel. If it has a bad reputation, it will be difficult to change the local opinion. A bad reputation drastically lowers the market value of the property.

Look at the financial statements for the past two or three years. Also, check the occupancy rate. Look at room rates and expenses for running the business. Check the room rates at nearby hotels and motels for comparison. Verify all financial information.

It is usual for the buyer to have a 30 day study period, and this is usually set down in the letter of intent or the agreement of sale. Use this period to check things out to your satisfaction. If you are not satisfied, you can back out of the agreement.

Review contracts that the current owner has with suppliers, as well as customer groups. Find out if those contracts will be renewed or valid after you take over the property. Be sure that the contracts will be satisfactory for you as the owner of the property. If there are existing contracts that you may wish to cancel upon purchasing the property, make sure that you will be able to cancel those contracts without being penalized.

Make sure that the hotel or motel is currently in compliance with governmental requirements. Also consider what licenses and permits you will need to get to operate the property, as well as the requirements and costs in obtaining those licenses and permits. Find out what insurance company is currently insuring the property and how much the premiums are. Do your own insurance shopping as well to see if you can get better coverage, or a better rate.

Bill Would Allow Property Insurers To Raise Rates In Florida

Edsel Hulse, a veteran who lives in Hollywood, said he's expecting his Citizens Property Insurance Corp. windstorm insurance policy premium to increase this year because state legislators in 2009 approved allowing the insurer to boost premiums by up to 10 percent annually.

But he's also worried that may not be the last of it. Hulse, like many other South Florida insurance policyholders, is apprehensive about new insurance laws the Legislature is slated to take up when it convenes its annual session March 2.

Key Florida lawmakers are drafting legislation that would essentially allow additional property insurance rate increases and reduce fraudulent claims and discounts that can drive up insurance costs.

Sen. Garrett Richter, R-Naples, who leads the Senate's insurance committee, and Rep. Bryan Nelson, R-Apopka, said they plan to file broad property insurance measures that would expand on an insurance bill passed last year that, among other things, allowed insurers to increase premiums by up to 10 percent to pass certain backup coverage costs to policyholders.

"With that bill we crossed the starting line, which is dramatically different than crossing the finishing line," Richter said.

Richter and Nelson, who sponsored the bill last year, are considering having other fixed costs included in the 10 percent provision. That could drive up the cost of Hulse's homeowner policy, covered by a private insurer. "So now instead of worrying about taxes, I have to worry about insurance," Hulse said, adding that 40 percent of his monthly income already goes to paying insurance premiums, utility bills and taxes.

Insurance industry executives say rates aren't high enough to build claims-paying reserves and are pressing lawmakers for relief. "Even though Florida has gone four years without a hurricane, many major property insurers lost money in 2009," wrote the Florida Insurance Council, a trade group, in a recent report.
The state's Office of Insurance Regulation approved 99 homeowner insurance proposals to increase statewide average rates last year by 0.2 percent to 27.9 percent and 15 proposals to decrease rates, according to data from the agency.

Insurance Commissioner Kevin McCarty told a panel of senators in October that 102 of 210 property insurers with a significant presence in Florida reported that premiums collected during the first half of the year weren't enough to cover claims and expenses. But McCarty also said that 150 of the companies reported an increase in claims-paying reserves. Specific Florida figures aren't available.

Overall, U.S. property and casualty insurers are expected to earn a net income of $30.6 billion in 2009, up from $3.8 billion in 2008, according to a report this month from A.M. Best, which rates the financial health of insurers.

Senate President Jeff Atwater — who co-sponsored a law passed in 2008 that extended Citizens' rate freeze and allowed regulators to reject rate increases before they took effect — said Florida's insurance market is healthier now but still needs help.

"We're focused on two fronts: Not doing anything that would make it more difficult for consumers to get prompt payment of claims and fair pricing," said Atwater, R-North Palm Beach, adding that legislators also want to show insurers that Florida has a fair regulatory environment.

Stephen Marino, an attorney for policyholders at Ver Ploeg & Lumpkin in Miami, said the Legislature has bigger issues to deal with. "It troubles me that the insurance industry is causing legislators to expend resources on these changes for no good reason other than because the industry wants them," he said.

Like other major industries, insurers are aggressive in pushing their agenda. The Republican Party of Florida received more than $1.5 million from insurance industry representatives and groups last year and the Democrats received more than $600,000, according to state campaign finance records.

Sen. Mike Bennett, R-Bradenton, and Rep. Bill Proctor, R-St. Augustine, proposed legislation this year that would essentially allow insurers to increase rates as much as they want. Gov. Charlie Crist vetoed a similar bill they proposed last year and vowed to do the same this year.

Sam Miller, executive vice president of the insurance council, said his group supports the idea but has resigned itself to the fact that it won't get far. He said legislators should at least allow capped annual rate increases as they did for Citizens. "We need a glide path [increase] for private insurers. It's gotta be capped. It's gotta be incremental," Miller told the Sun Sentinel editorial board last week.

Bill Newton, executive director of the Florida Consumer Action Network, said consumers can't afford 10 percent increases every year and insurers "don't deserve that kind of latitude."

Insurance Consumer Advocate Sean Shaw said that if legislators limit the state's authority to shoot down rate increases, they should consider allowing his office to participate in insurance rate hearings on behalf of consumers — much like the Office of Public Counsel does for utility proposals.

Richter and Nelson's bills aim to:

Prevent inspectors from inflating discounts. Legislators want to beef up the state's regulation of home inspections because some homeowners are getting discounts they don't deserve for fortifying their homes against hurricanes. After recently inspecting 452 homes, Citizens found 311 were not eligible for the discounts.

Increase the state's authority to set common guidelines on the scope of damage during mediation, a program to help resolve disputes between insurers and policyholders over claims.

Reduce fraud that drives up costs for insurers. One idea is to undo parts of a 2005 law that required insurers to pay the full cost of replacing damaged items before repairs are made. "What's happening is the policyholder is saying, ‘I'm going to get my $2,000, $3,000 for the kitchen floor but I'm not going to replace the kitchen floor,' " Nelson said. Another idea is to limit the time policyholders have to open claims after a hurricane.

A state fund that sells catastrophe coverage to insurers reports that it must raise up to $710 million more to pay for losses from the 2005 hurricane season. It proposes increasing a fee that all automobile and property insurance policyholders pay from 1 percent of premiums to 1.3 percent.

"We're supposed to only pay claims that are due, not that are inflated," said Stacey Giulianti, the chief legal officer of Boca Raton-based Florida Peninsula Insurance Co.

Marino said insurers' claims of fraud are overblown. A recent state study found that in the past six years, the Division of Insurance Fraud received 937 complaints about fraud related to public adjusters from insurers and others, investigated 269 of them and made 31 arrests from 2004 to 2009.

I recently read a story about a company that charged additional premium for a 16 year old who did not hold a learners permit and obviously is an unlicensed driver.

Under typical rules you should not be charged for a youthful driver unless they are a resident of the household and operate a vehicle. According to Michael Merrritt, Assistant Director of the U.S. Secret Services office of Investigations, cyber criminals are increasingly targeting small and medium sized businesses that don't have the ability to keep updating computer security.

Texting While Driving New Concern For Employers

Employers are concerned that they may be held liable for accidents caused by their employees while drivng and conducting work related conversations on cell phones. Under the doctrine of vicarious responsibility the employer can be held liable for negligent acts of their employees committed in the course of employment.

Employers can also be held accountable if they do not have a policy in place for safe use of cell phones. It has become more common for employers to put into action a cell phone policy to protect the business from potential liability. Defensive Driver Class Could Help Teen Drivers

Parents beware: Giving in to teens' demands for their own cars can have dangerous consequences, new research suggests.

Teenagers with their own cars or free use of one are much more likely to get in crashes than those who share a car. And crashes are much less common among teens whose parents set clear driving safety rules.

The findings are in two studies by researchers at Children's Hospital of Philadelphia and funded by State Farm Insurance Co. They are in the October issue of Pediatrics.

The researchers say the findings can help parents keep their kids from becoming a grim statistic: Traffic crashes are the leading cause of death for U.S. teens, killing more than 5,000 each year.

Getting a driver's license and car are often viewed as rite of passage for U.S. teens, and many parents underestimate the risks.

More than 7,000 people nationwide were killed in crashes involving teen drivers in 2007, government data show. More than 3,000 of these deaths were teen drivers, and more than 250,000 teen drivers were injured.

"With teen drivers, you have to recognize that it's a public health issue,'' said Dr. Jeffrey Weiss, a Phoenix pediatrician who co-wrote an American Academy of Pediatrics report on teen drivers.

The 2006 report encourages parents to highlight the seriousness of driving privileges by requiring teens to sign driving contracts promising to abide by safety rules.

The new research shows that kind of hands-on approach pays off.

"Families need to know that driving is different'' from other steps toward independence,said Dr. Flaura Koplin Winston, the study's lead author. "Just at the time their teen is pulling away, they need to get back involved to spare them heartache.''

The research is based on a nationally representative survey of more than 5,500 teens in grades nine through 11. Students at 68 high schools answered questionnaires in 2006.

More than 2,000 students who reported driving on their own were the focus of one study; 70 percent said they had their own cars or were the main drivers of cars they used.

Winston said it's alarming that so many kids have their own cars or feel that they have free use of one. She said that freedom can lead to "a sense of entitlement about driving'' that may make them less cautious.

Among these "main'' drivers, 25 percent had been involved in crashes, versus just 10 percent of teens who shared driving access. Winston said the lower crash rate doesn't reflect less driving time, but is likely due to having to ask for the car keys, which helps parents monitor their kids' driving.

Compared with teens whose parents were uninvolved, kids who said their parents set clear rules and monitored their whereabouts without being overly controlling had half as many crashes and much better driving habits.

These teens were 71 percent less likely to drive while drunk and 30 percent less likely to use a cell phone while driving than kids with uninvolved parents.

Dr. Niranjan Karnik, a University of Chicago specialist in adolescent mental health, said the research underscores the importance of appropriate parenting and widely enacted graduated licensing laws for teens.

Debby Hendricks of Hatfield, Pa. made her daughters wait until age 17 to get their licenses, and gave them lots of driving practice beforehand.

The girls, aged 17 and 19, also share a family car, and can't "just grab the keys and leave'' without saying where they're going and with whom, Hendricks said.

So far so good -- neither girl has been in an accident, although the younger one, Leslie, has only had her license for a few months.

Leslie considers herself a safe driver, but adds, "I probably do underestimate the risks.''

Sept. 19 (Bloomberg) -- New York state’s insurance regulator suggested Moody’s Investors Service should have its authorization to rate insurers’ holdings scaled back after the firm declined to attend a public hearing set for next week.

“This is the thing that forces one to ask questions about the role that a company like that can play in our regulatory system,” Hampton Finer, deputy superintendent and chief economist at the New York Insurance Department, said yesterday in a phone interview. “We think there should be discussion about whether Moody’s will have its authorization status going forward or having it curtailed in some fashion.”

Finer said he may advocate that regulators throughout the country rely on Moody’s competitors to rate securities held by insurance companies. Moody’s could lose business if that that happens, he said. Insurers can hold certain securities without explicit regulatory approval if those investments are rated by an authorized firm.

Standard & Poor’s, Fitch Ratings and Dominion Bond Rating Service Ltd. plan to meet next week with U.S. state regulators on the role the firms play in grading the insurers’ fixed-income holdings, the National Association of Insurance Commissioners said in a statement posted on the Web. Moody’s was invited and won’t attend, said Scott Holeman, a spokesman for the NAIC.

Thomas Lemmon, a spokesman for Moody’s, declined to immediately comment. Vanessa Sink, a spokeswoman for the NAIC, declined to discuss Finer’s remarks.

New York’s Role

New York Insurance Superintendent James Wrynn and Michael McRaith of Illinois convened the meeting as heads of a group appointed by the NAIC to evaluate watchdogs’ reliance on the firms. U.S. insurance companies hold about $3 trillion in rated bonds including corporate debt and mortgage-linked bonds.

Regulators use the firms’ ratings as they monitor insurer portfolios to make sure carriers have enough funds to pay claims on policies ranging from mortgage guarantees to earthquake protection.

Moody’s and S&P, both based in New York, have been criticized by investors and lawmakers including Senate Banking Committee Chairman Christopher Dodd, who has said the companies wrongly assigned top credit rankings to subprime-mortgage bonds before that market collapsed in 2007.

Standard & Poor’s spokesman David Wargin declined to comment, as did Kevin Duignan, a spokesman at Fitch, and Caroline Creighton, a spokeswoman at DBRS. Fitch is a unit of Paris-based Fimalac SA, S&P is a unit of McGraw-Hill Cos. and Moody’s is a unit of Moody’s Corp.

The hearing is set for Sept. 24 in Maryland. The Securities and Exchange Commission will also participate.
